General Terms and Conditions of Sale

ARTICLE 1 – Services

These General Terms and Conditions of Sale apply to all services provided by SARL Vertic'O, concerning the following services:
Teaching climbing, canyoning, via ferrata, via corda, caving, airboarding and summer and winter hiking.
All the instructors acting on behalf of SARL Vertic'O are qualified professionals in the supervision of the activities offered, and provide the specific equipment required to carry out the service ordered.
The planned programme of services may be modified according to the weather, the level of one or more participants or any other factor deemed important by the SARL Vertic'O instructor.

ARTICLE 2 – Booking

Any registration for an activity implies :
- acceptance of these terms and conditions
- not having any medical contraindications to taking part in the activity
- having read and understood the General Terms and Conditions for the activities (particularly for canyoning)
- the person making the booking undertakes to inform all participants of the conditions of participation and the progress of the activity.

A deposit of 30% of the total cost of the activity is required at the time of booking.
If the customer cancels the booking less than 10 days before the activity, the deposit paid will not be reimbursed, except on presentation of a medical certificate of contraindication.
If the customer cancels the booking at least 10 days before the event, the deposit will be refunded.
If SARL Vertic'O cancels a booking (due to insufficient numbers of participants, bad weather or other force majeure events) and if it is not possible to provide the service at a later date, the deposit will be refunded.

ARTICLE 3 - COVID-19

The activities will be supervised in compliance with the health regulations in force at the time of the activity.
During the activity, the customer undertakes not to be positive for COVID 19, not to have any symptoms linked to this virus and not to be a contact case of a positive person.

ARTICLE 4 - prices

The services are provided at the rates in force on the day the reservation is made.
An invoice is drawn up by Vertic'O for each service provided and can be given to the customer on request.

Group and individual rates are applied on the basis of a minimum number of people present on the day of the service.
The customer undertakes, depending on the actual number of people present on the day of the service, to change the rate per person accordingly (from a group rate to an individual rate and vice versa).
Preferential rates, set up in agreement with partners, are applicable on presentation of proof of entitlement. Only those with proof of identity are entitled to discounts.

The price includes supervision by a qualified professional and the loan of all equipment required for the activity. Transport and food are not included.

Customers may pay for the entire activity in advance. If an amount is due, it must be paid in cash, cheque or ANCV cheque on the day of the activity at the latest.

ARTICLE 5 - Terms of payment

The customer undertakes to pay the balance of the invoice on the day of the service in cash, cheque or ANCV cheque.
No discount will be granted for payment within the time limit specified above.
In the event of a medical problem during a course, a partial refund on a pro rata basis of the days not completed may be made on presentation of a medical certificate only.

ARTICLE 6 - Insurance

SARL Vertic'O uses independent instructors and undertakes to ensure that they are all insured for professional liability for the current year.
The customer undertakes not to present any contraindication to the practice of the chosen activity. Any health problem or current medical treatment must be indicated by the client to SARL Vertic'O when registering.

ARTICLE 7 - Theft and breakage

SARL Vertic'O and the instructors cannot be held responsible for theft, breakage or loss of equipment in the vehicles during an activity.
However, we recommend that you only take the equipment you need during the activity.

The instructors and SARL Vertic'O cannot be held responsible for the loss or breakage of any equipment that the client may have taken with them during the activity (camera, personal camera, etc.).

ARTICLE 8 - Advertising

By participating in a service provided by SARL Vertic'O, the customer accepts that the photos and/or videos taken during the outing may be used for commercial purposes by SARL Vertic'O. If this is not the case, the customer must request this in writing before the date of the outing.

Photographs taken during activities are offered by Vertic'O and are not due. However, it may happen that a camera is damaged, leaks or is unusable for any other reason and that we are then unable to take photos while we replace it.
This happens very rarely and we apologise in advance!

ARTICLE 9 - Customer acceptance

The present General Terms and Conditions of Sale are expressly agreed and accepted by the customer, who declares and acknowledges that he/she is fully aware of them, and therefore waives the right to rely on any contradictory document and, in particular, his/her own general terms and conditions of purchase, which will be unenforceable against SARL Vertic'O, even if he/she is aware of them.
